Article 1 – Scope and identification

1. The Sites are not only an electronic site accessible via the internet network, open to all users of this network, but also an application accessible to any user of Apple and Android systems.

2. The Sites are published by France Billet. France Billet acts on behalf of Event Organisers. Consequently, the GTS only concern ticket sales services and not the Event itself. Certain activities offered, particularly sporting activities, may also include conditions or internal regulations specific to the Organiser or the site in question, which are available from the said site and/or the said Organiser.

3. The GTC are concluded between France Billet and the Client, a natural person of legal age capable of contracting, or a minor under the responsibility of their legal representative. Local authorities and resellers are not authorised to purchase tickets under the conditions set out herein.

4. The Sites offer the Client access to a remote ticket sales platform.

5. France Billet reserves the right to modify the GTS without prior notice. Any new version of these will be notified to the Client on the Sites, and it will be their responsibility to take note of it.

The online version on the Sites shall prevail over any other version of these General Terms and Conditions of Sale, except for modifications made after an order, which, in accordance with common law, shall not apply retrospectively.

Article 2 – Information & Complaints

For any questions or complaints regarding the management of their order, the Client can submit a request form via the "Contact customer service" button by following this link: Shows FAQ.

For any other question not related to the management of their order, the Client may send it by email to the following address: moncompteclient@francebillet.com.

Article 3 – Object

The GTS are intended to govern the contractual relationship between France Billet and the Client for any transaction carried out by the Client for the purchase of a Ticket offered on the Sites.

For each order, the Client must first accept the GTS.

It is specified that the GTS exclusively govern the sale of Event Tickets on the Sites and take precedence over all other purchase conditions, unless a formal and written exception is made by us, which could be established for specific Events.

Article 4 – Orders

1. Creation of a Customer Account

In order to finalise their order, the Customer must first create a 'customer account' (hereinafter referred to as 'the Customer Account') on the Website or the App by completing the form provided for this purpose under 'Login/Sign Up'. To enable the creation of the Customer Account, all the requested information marked with an asterisk must be completed by the Customer.

The Client acknowledges that providing any incorrect, incomplete, or false information may incur their liability both towards France Billet and third parties. In the event of providing incorrect, incomplete, or false information (or failing to update such information), France Billet may decide to suspend or terminate the Client Account, with immediate effect and without prior notice.

The Customer Account allows the Customer to identify themselves on the Sites and place any order using a username and password. Consequently, the Customer is solely responsible for the confidentiality and security of their Customer Account, their username, and their password required to log in and thus access the Customer Account and its services. The Customer must take appropriate measures to prevent third parties from becoming aware of their username and password.

Any order for which the Client has been identified using their password and a valid identifier will be processed by France Billet and will bind the Client concerned unless they can demonstrate that the erroneous identification results from a failure of the Site and/or the App.

The Sites allow the Client with a Client Account to search for, order, and pay for Tickets. It also allows the Client to access all information related to their past orders.

In case of non-compliance with the terms of use of the Sites or abusive or fraudulent use of the Sites, France Billet may refuse a user access to the Sites and the ability to place an order.

2. Placing an Order

The placing of an order by the Client on the Site or on the App proceeds as follows: The Client accesses the categories of Events they desire and offered by the Sites;
The Client selects and adds the chosen Ticket(s) to the basket;
The Client validates their basket;
The Client creates or logs into their Client Account;
The Client completes the information necessary for the validation of their order;
The Client acknowledges the GTC of the Sites;
The Client makes the payment for their order after verifying their selection and after ticking the box "I accept the general terms and conditions" and "I accept the data protection charter conditions".
The Client confirms their order and payment.

The confirmation of the order constitutes acceptance of the GTS, acknowledgment of having full knowledge of them, and waiver of invoking other conditions.

The set of data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will constitute a signature and acceptance of the operations carried out.

Upon receipt of the bank account debit authorisation issued by the Client's bank, France Billet will send an email confirmation of the order recorded in the form of an email sent to the address provided by the Client when creating their Client Account.

The order will only be definitively confirmed upon receipt of this email summarising all the information provided by the Client, including, where applicable, any issues or reservations raised regarding the order, as well as the reference number assigned to the order by France Billet.

France Billet reserves the right not to proceed with the Client's order in the event of a legitimate reason related to the trust it has in the Client, and in particular: a) In the case of order(s) exceeding, by their content or frequency, the needs of an individual and more generally in the case of an abnormal or proven bad faith request from the Client; b) In the case of information from the banking institution responsible for managing the payment of the order on behalf of France Billet indicating the impossibility of implementing the chosen payment method for the order; c) In the case of a dispute with the Client; d) In the case of total or partial non-payment of an order by the Client.

To ensure the proper execution of the sale, France Billet reserves the right to request additional information from the Client and to refuse the execution of the order in the absence of an adequate response.

Article 5 – Seating Plans and Location of Seats

Depending on the configuration of the room and the Event, the following seats may be offered to you:
Numbered seats
Seats belonging to multiple categories, each corresponding to different areas of the venue, which may or may not be numbered
Free seats throughout the hall

During the process of placing your order, your seats may be shown on a seating plan if one is available. The location on this plan is provided in the most representative way possible. However, depending on the actual size of the venue depicted on the plan, the location may indicate either the precise seat or an area of the venue where your seats are located.

The Event Organiser is responsible for providing France Billet with details regarding visibility based on seating arrangements in the venue. France Billet is responsible for informing Customers based on the information it has. Under no circumstances can France Billet be held liable for reduced visibility and the lack of information provided to the Customer if the Organiser has not informed France Billet.

Article 6 – Availability

Reservations and ticket purchases are made in real time.

In this context, our server informs you in real time about the availability of Tickets at the time of placing your order.

In case of unavailability in one of the requested seat types, our server automatically offers you the best remaining seats.

In the basket, the 'Your reservation' page allows you to check that the seats assigned to you match your preference.

If these seats do not suit you, you have the option on the "My Basket" page to cancel them by clicking on the corresponding "Cancel" button.

Article 7 – Price and Number of Seats

1. Price

The ticket prices (face value) are indicated in euros, all taxes included, excluding the handling fee contribution indicated below.

The price of Tickets cannot be modified without the Organiser's consent. At the Organiser's discretion, prices are subject to change at any time and without notice, and Tickets will be charged to the Customer based on the rates in effect at the time of order confirmation.

All orders are payable in euros regardless of the country of origin of the order.

Transaction fees are added to any Ticket order. These fees help cover the technical and maintenance costs of the Sites, banking fees, and customer service.

Transaction fees vary depending on the total amount of the basket.

2. Number of Seats

The total number of seats in cumulative reservations per Client cannot exceed the number of seats defined by the Organiser across all categories and, failing that, by France Billet. The same Client cannot place multiple orders spaced out over time to circumvent this rule.

Different types of rates may be offered to you depending on the Events.

Regarding the "group" rate, when offered, a minimum number of seats determined by the Organiser is mandatory (usually between 15 and 20, unless exceptions).

For certain Events, at the request of the Organisers, you will receive vouchers instead of tickets: in this case, the tickets must be collected, in exchange for the vouchers, at the entrance of the venue, 30 minutes before the start of the Event.

Unless otherwise indicated, the total number of seats in cumulative reservations per person cannot exceed 20 for the same show.

It is prohibited for multiple buyers to make, via automated or non-automated booking methods, simultaneously or through purchases spaced over time, multiple bookings with the same bank card.

It is also prohibited for a single buyer to make multiple bookings with different bank cards.

In case of non-compliance with these rules, France Billet reserves the right to cancel the order or orders.

Article 8 – Payment

1. We remind you that confirming your order implies an obligation on your part to pay the indicated price.

The payment for the order can be made using the payment methods accepted on the Sites.

The payment can be made using gift cards and bank cards through secure payment: Carte Bleue, Visa, Mastercard.

In case of partial payment with a gift card, the remaining balance can be paid by credit card.

2. Payment by credit card or gift card allows you to book your Tickets online and immediately on a firm basis.

3. The Tickets remain the property of the Organiser until full and final payment of the price by France Billet.

Article 9 – Securing Payments and Personal Data

1. Securing Payments

Our Sites are subject to a security system.

We have adopted the 128-bit SSL encryption process, but we have also strengthened all scrambling and encryption processes to protect as effectively as possible all sensitive data related to payment methods. As part of the fight against fraud, we have implemented 3D Secure payment, an authentication payment system. This service is free and may be triggered for your payments by Carte Bleue, Visa, and MasterCard. With 3D Secure (or Verified by Visa or MasterCard SecureCode), your bank verifies your identity at the time of payment. Since the identification process is specific to each bank, please check with your bank for the authentication process used.

2. Personal Data

France Billet processes personal data concerning you that is necessary for the management of your order and our business relations. This information and data are also retained for security purposes, to comply with legal and regulatory obligations, as well as to enable us to improve and personalise the services we offer you and the information we send you.

To learn more, we invite you to consult our Personal Data policy click here.

In accordance with the regulations on personal data protection, you can exercise your rights (access, rectification, deletion, objection, restriction, and portability where applicable) by using the contact form accessible via the "Contact customer service" button or by contacting us by post: France Billet - Customer Service, 27-35 rue Victor Hugo 94200 Ivry sur Seine

To enable us to respond quickly, we kindly ask you to provide your surname, first name, email, address, and, if possible, your customer reference. When it is not possible for us to confirm your identity by other means, we may ask you to provide a copy of an identity document bearing your signature. A response will then be sent to you within one (1) month of receiving the request.

Article 10 – Contribution to Costs

²

Each order is subject to a Client contribution to technical costs.

The amount of contributions to these costs is included in the basket details, in the order summary separately from the order price and on the invoice. They are therefore specified before the order is validated and paid for by the Customer.

The Client acknowledges being fully informed of the fees that are added to the Ticket Prices ordered.

Article 11 – Validation & Confirmation of the Order

1. When the Client clicks on the "Validate" button at the end of the ordering process, on the "Payment" page, and declares acceptance by ticking the box "I accept the general terms and conditions of sale", they declare full and unconditional acceptance of all the General Terms and Conditions of Sale.

2. The Ticket order is only definitively confirmed and binding on France Billet upon receipt by the Client of the email confirming that the Ticket order has been successfully validated.

Consequently, we invite you to check your email inbox as well as the spam folder.

The proof of payment and the Tickets are sent to the email address of the Customer Account.

Article 12 – Obtaining Tickets

12.1. The conditions for sending Tickets are specific and independent of the delivery conditions for other items sold on Fnac.com. In particular, 24-hour delivery and collection at Relais Colis do not apply to Tickets sold on the Sites.

12.2. On the Site, the Client has the option to choose between three (3) methods of obtaining Tickets, namely:
- obtaining an electronic Ticket (E-ticket);
- the collection in-store at Fnac of a thermal Ticket;
- the registered sending of a thermal Ticket.

12.3. On the App, the Client has the option to choose between four (4) methods of obtaining Tickets, namely:

- obtaining an electronic Ticket (E-ticket);
- obtaining a "Pass" Ticket;
- the collection in-store at Fnac of a thermal Ticket;
- the registered sending of a thermal Ticket.

12.4. Click and collect

It is understood that in-store pickup only applies to Fnac stores. The Customer is free to go to the Fnac store of their choice.

To ensure maximum payment security for the Customer, in-store collection must be carried out by the holder of the bank card used for payment.

The bank card used for payment, the order number provided in the order confirmation email, as well as an identity document, will be requested from the Client.

Without the presentation of the documents listed above, the Tickets cannot be handed over to the Client.

It is specified that an E-Card Blue does not allow in-store withdrawal of Tickets.

The Client's bank card is debited as soon as the final validation of the order placed by the Client is completed. The debit is independent of the actual collection of the Tickets. In any case, the Tickets are paid for even if the Client fails to collect their Tickets in-store.

12.5. Registered mail

When the time between the booking date and the event date allows, the Client has the option to choose registered delivery as the method of obtaining the Tickets in exchange for payment of the shipping and handling fees, the amount of which is displayed at the time of ordering.

The Tickets are sent to the Client at the address provided by the Client when placing the order.

12.6. E-Ticket

E-Tickets are provided with a unique barcode. The validity of the Tickets is checked and recorded at the entrance using barcode scanners. It is not possible to be admitted multiple times with the same Ticket. Reproducing tickets is prohibited and will not provide you with any advantage. Only the first person to present the Ticket will be admitted to attend the Event.

Keep your Ticket in a safe place. Consequently, France Billet declines all responsibility in case of loss or theft of your smartphone. No duplicate or certificate, reissue of the Ticket of any kind, other than the initial electronic ticket, will be provided to the Customer.

If the E-Ticket is printed, the printing must be done in portrait mode on a white A4 sheet.

The Organiser may refuse the Client access when multiple prints, reproductions, copies, or imitations of an E-Ticket are in circulation and access to the event has already been granted to the holder of a print, reproduction, copy, or imitation of the corresponding E-Ticket. The Organiser is not specifically obliged to verify the identity of the person presenting the E-Ticket to ensure they are the ticket purchaser, nor to verify the authenticity of the E-Ticket if the imitation or copy cannot be unmistakably identified as such during the entry check for the event. If the holder of an E-Ticket is denied entry for this reason during an access check, there is no entitlement to a refund of the price paid.

The Client will be able to retrieve their E-Tickets at any time until the date of the Event on the Sites in the "My Account" section and then "My Orders".

The Client must take all necessary precautions to keep their password confidential and to prevent any use by unauthorised persons.

12.7. The 'Pass' Ticket

For certain Events, receiving a 'Pass' Ticket is available. The secure PASS technology allows the receipt and use of your PASS Tickets in a secure and fully digital way, only via the App previously downloaded on your compatible mobile device. The Pass Ticket will be accessible to the Customer in the App after purchasing the Ticket. The Pass Ticket, including the QR Code allowing access to the Event, is displayed on the App shortly before the start of the Event and can only be transferred through the App.

The purchase of a Pass Ticket does not result in the issuance of a paper entry ticket or in any other form. The Pass technology makes it impossible to take a screenshot of the Pass Ticket. The Event security staff may verify at any time that you legitimately hold your Ticket.

The Client acknowledges that it is their responsibility to have all the necessary technical facilities to receive and provide the Pass Ticket.

France Billet disclaims all responsibility for anomalies occurring during the ordering, processing, printing, or use of Passes insofar as France Billet has not caused them intentionally or through negligence in cases of loss, theft, or misuse of the App by the Client. No duplicate of the Ticket of any kind will be issued to the Client.

You will find additional information and explanations regarding the Pass Ticket and its use within the Shows FAQ.

Article 13 – Cancellation, Refund, Use

1. No Right of Withdrawal

It is expressly recalled that, under the terms of Article L221-28 12° of the Consumer Code, the Client cannot exercise their right of withdrawal concerning leisure activity services that must be provided on a specific date or during a determined period. Orders consisting of Tickets will therefore not be subject to any refund, as the said service provisions related to the Tickets are in any case designated as such to the Clients, prior to the conclusion of the sale, in the description of the offer made.

2. Cancellation & Postponement

The Events take place under the sole responsibility of the Organiser. France Billet cannot, under any circumstances, be held liable.

Upon the announcement of the cancellation or a change of date, time, or location of an Event for which the Customer has ordered Tickets, the Customer agrees that France Billet, as far as possible, when it has itself been informed by the Organiser, may use the contact details entered by the Customer during their order to keep them informed of the next steps.

In the case of musicals, theatrical performances, etc., where artists and/or actors often perform 6 to 8 times a week over several months, cast changes may result as is customary in live performances to preserve the abilities of the artists and/or actors. Changes in the cast do not entitle the Client to any form of compensation, and no claims will be considered.

In the same way, the reduced visibility of the Client during the Event shall in no case give rise to any compensation from France Billet.

In the case of a sporting event, if it does not take place or is permanently stopped in the first half or at halftime, the Tickets remain valid for the rescheduled or replayed event, but they can be refunded at the request of the Customers under the conditions provided by the Organiser.

We invite the Client, in any case, to check 24 hours before the Event that it is indeed maintained without modification.

A Ticket cannot be refunded even in case of loss or theft, nor returned, nor exchanged by France Billet except in the event of cancellation or postponement of an Event in accordance with the provisions 3. below.

3. Reimbursement

In the event of the cancellation of the Event by the Organiser, only the Ticket price will be refunded, excluding ancillary costs such as the fees defined in Article 10 and any cancellation insurance which will not be refunded).

This refund will only be made in favour of the Client who placed the order and made the payment. In any case, no fees of any kind will be refunded or compensated.

The refund request must be made within 30 calendar days after the date of the cancelled Event. Beyond this period, it is inadmissible, and no refund can be issued.

The refund request must include the Client's order references and proof of the order. The refund request must be sent via the "Contact customer service" button by following this link in the FAQ.

In the event of an interruption of a performance beyond half of its duration, the Tickets cannot be exchanged or refunded. In the event of cancellation, the responsibility of the Organisers will be exercised in accordance with the legal conditions specific to them, independently of the GTS.

4. Usage

A Ticket cannot also be resold at a price higher than the Ticket's price (face value).

During the check at the entrance to the Event venue, a valid photo ID may be requested, and it must match the name on the Ticket if it is nominative.

Article 15 – Intellectual Property and Image Rights

The Site and all its components, such as the domain name, any trademark, logo, software, structure, database, graphic charter, design and model, illustration, animation, image, text, are protected by intellectual property rights.

France Billet, or where applicable, third parties with whom France Billet has entered into usage or exploitation agreements, are the exclusive holders of the intellectual property rights related to the Site and all its components, as listed above. The GTS do not transfer ownership of these elements to the Organisers or the Client. Any unauthorised copying, reproduction, representation, adaptation, alteration, modification, distribution, whether in whole or in part, extraction or reuse, repeated or systematic, including for private purposes, of all or part of the Site, by any means whatsoever, constitutes an infringement.

Under intellectual property law and image rights, the Tickets do not grant Clients any right to capture or record the Event in any form or by any technical means whatsoever.

It is notably forbidden to photograph the Event, to make videos and sound recordings.

Any offender may, as a result, be denied access to the Event or expelled from the venue during its execution, even during the performance, without the possibility of a refund. France Billet and/or the Organiser will also reserve the right to take any legal action they deem appropriate.

Article 16 – Liability

Any complaint or criticism made by the Client regarding the Event or the services offered will be communicated to the Organiser as part of a future improvement of the service as a whole but will not give rise to any refund or compensation.

The Tickets offered comply with the French legislation in force. France Billet disclaims all responsibility in the event of non-compliance with the legislation of the country to which the Tickets will be shipped.

France Billet cannot be held responsible for any damages, of any kind, that may directly or indirectly affect the personal belongings, items, or materials brought by the Client to the Event. France Billet is not responsible in the event of a failure to meet its obligations, as defined herein, due to the occurrence of events constituting force majeure, as typically recognised by law and case law.

Furthermore, expressly considered as cases of force majeure are total or partial strikes, internal or external to the company, lockouts, severe weather conditions, epidemics, acts of terrorism, blockage of transport or supply means, for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, the total or partial blockage of energy sources, particularly oil, or telecommunication means whose cause is beyond the control of the parties, and more generally, any event independent of France Billet affecting its activity, that of the venue where the Event is to take place, that of one of its suppliers or subcontractors, which could render it absolutely or partially unable to fulfil its commitments.

The responsibility of France Billet cannot be engaged under any circumstances for any indirect or intangible damage.

It is strongly advised not to travel during the Event, and in the event of an accident, the responsibility of France Billet in this regard cannot be engaged.

The Client remains solely responsible for any direct or indirect damage they may cause during their presence at the location where the Event takes place and must personally answer for it on a criminal or civil level.

Article 17 – Control and Security

The Client expressly agrees to comply with all control or verification measures intended to ensure the safety of people and property within the Event venue. A search may be conducted at the entry checkpoint, to which the Client must lend their cooperation.

The Client must, at all times, be able to present their ticket to the representative of the venue where the Event is taking place, and this, until the end of its execution.

Except in exceptional cases (where an exit voucher will be issued, at the Client's request and with the Client's agreement, valid only with the ticket initially purchased by the Client), any exit is considered final and terminates the contractual relationship.

In any case, the Organiser and the Event venue will be free to set the security measures and access conditions for the Event.
